These are plain-English terms. We've written them to be readable, not to trap you. The short version: be a good person, don't abuse the platform, and we'll all have a good time.
These Terms of Service ("Terms") govern your use of the CheckOff mobile application and website (collectively, the "Service"), operated by CheckOff ("CheckOff," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
You must be 13 or older to use CheckOff. By creating an account, you confirm you are at least 13 years old.
Your account. You are responsible for maintaining the security of your account and for all activity that occurs under it. Use a strong password and do not share your credentials. Notify us immediately if you suspect unauthorized access.
Accurate information. You agree to provide accurate information when creating your account and to keep it current.
One account per person. You may not create multiple accounts or impersonate another person.
You agree not to use CheckOff to:

CheckOff allows you to post content including photos (via the photo check-in feature) and messages (via dare challenges). You retain ownership of content you post.
By posting content, you grant CheckOff a non-exclusive, royalty-free license to store, display, and distribute that content within the Service. We will not use your photos for advertising without your explicit consent.
You are responsible for any content you post. Do not post content that violates others' rights, including copyright, privacy, or publicity rights. Do not post photos of people without their permission.
We may remove content that violates these Terms or that we determine is harmful to the community.
Some items on CheckOff are placed by local businesses and Creators ("Partners"), whether curated into the platform at no cost or through a paid plan. CheckOff makes no guarantees about Partner businesses — we do not endorse, warrant, or take responsibility for the quality, safety, or accuracy of any Partner business, offer, or item description.
Any transaction between you and a Partner business is solely between you and that business. CheckOff is not a party to such transactions.
The Nearby feature uses your device's GPS. Location access is optional — you can use CheckOff without enabling location. If you enable location, the data is used only to sort items by distance and is not stored on our servers in precise form. See our Privacy Policy for details.
The CheckOff name, logo, app design, item content, and all other materials we create are our property or are licensed to us. You may not copy, reproduce, or distribute them without our written permission.
The curated list of 500+ local experiences is our original work. You may use the list to discover things to do — you may not reproduce it commercially or build a competing product from it.
CheckOff is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that item information (hours, availability, menus) will be accurate or current.
Item descriptions are provided for discovery purposes. Always verify current hours, prices, and availability directly with a business before visiting. Businesses change.
Physical activities. Some items on CheckOff involve physical activities (hiking, kayaking, etc.). You participate in these at your own risk. CheckOff is not responsible for any injury, loss, or damage arising from activities you undertake after discovering them through the app.
To the maximum extent permitted by law, CheckOff and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or personal injury.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to CheckOff in the twelve months preceding the claim (which for free users is $0).
You agree to indemnify and hold harmless CheckOff and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
You may delete your account at any time. We may suspend or terminate your account if you violate these Terms, with or without notice.
Upon termination, your right to use the Service ceases immediately. We will delete your personal data within 30 days per our Privacy Policy.
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of CheckOff after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
